General

CANDORVISION (a division of Candorpharm Inc.) owns and operates this e-commerce web-portal, which is in turn subject to CANDORVISION’s Terms of Use. By accessing and using this web-portal, you agree to CANDORVISION’s Terms of Use and the Terms of Trade outlined below. CANDORVISION may withdraw or amend your access to the web-portal, and will not be liable if at any time the web-portal is unavailable.

Privacy Policy

Web-portal Use: By using this web-portal, you consent to provide CANDORVISION with information necessary to register and place orders, and you warrant that all data provided by you is accurate and truthful.

Information Collected: CANDORVISION is the sole owner of information collected on this web-portal. This information will be used it to conduct business with you, or to contact you directly if needed. We will not share this information, except when necessary to fulfill your order or request, when required or authorized by law (such as in a subpoena or court order), to collect fees, or to engage a third-party administrative service where the third-party is also bound by this Privacy Policy. It is important that your information remains accurate and up-to-date. If any of your information changes, you agree to inform CANDORVISION promptly of the changes. CANDORVISION takes reasonable precautions to ensure your information is kept safe from loss, unauthorized access, modification or disclosure. Credit card data is transmitted to and collected solely by a third-party payment processor (Stripe.com) and is subject to Stripe’s User Agreement.

Requesting Information: You may ask for personal information we hold about you, which we will provide upon request (detailed requests or other retrieval costs may be subject to a modest fee). Access to your information is not absolute and may be denied if personal information cannot be severed from a record containing confidential commercial information. Cookies and External Links: Our web-portal uses “cookies”, a small file which asks permission to be placed on your computer’s hard drive. The cookie helps analyze web traffic or remembers when you visit a particular site to help tailor a site to your preferences. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us. You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. Our web-portal contains links to external websites, which are not governed by this Privacy Policy.

Terms of Trade

By making an order using this web-portal, you are offering to make a purchase subject to the following Terms of Trade. All orders are subject to availability and approval by CANDORVISION. When you place an order, you will receive an acknowledgement confirming receipt of your order: this will not constitute acceptance of your order. A contract between CANDORVISION and you will not be formed until we send you confirmation by e-mail that the order has been approved and processed. If paying by credit card, the transaction will only be processed once your order has been approved and confirmed by CANDORVISION.

Payment Terms: If paying by any other method than credit card, payment terms of net 30 days unless specified otherwise will apply. Invoices that are not paid according to CANDORVISION’s Terms of Trade are subject to a late payment charge of 1.25% per month (15% per annum) or the highest amount allowed by law if lower.

Minimum Order / Transportation: The standard shipping method is ‘regular ground’. Ground transportation charges are paid by CANDORVISION on orders totalling $250 / $500 net (or more for certain remote locations), subject to geographic location. A charge of $50 (or more for certain remote locations) will be added to invoices for orders less than the applicable minimum. If you request a more expensive method of transportation, you must assume any additional transportation costs. Please note we require order quantities in “round” numbers (e.g. 10, 20, 30 etc. for each individual product/SKU). CandorVision does not deliver to residential addresses.

Prices / Taxes: All prices are net of any applicable taxes and are subject to change without notice by CANDORVISION.

Conditions for Return, Replacement or Refund: All sales are final except under exceptional circumstances:

Any return must first be pre-authorized in writing by CANDORVISION, by contacting orders@CANDORVISION.com or (514) 380-5270, ext. 3.
If a return is authorized, either a new replacement item will be shipped at no charge or a full refund will be credited to your account.
Only items purchased directly from CANDORVISION and bear an intact CANDORVISION label will be considered for return.
Returned items must be returned accompanied by a detailed list of the returned items and the authorization number supplied by CANDORVISION.

Reasons that may be considered for refund or replacement include, but are not limited to, the following:

Goods damaged in transport or goods missing: The extent of damage and/or shortage must be noted immediately on the delivery receipt by the receiver and countersigned by the representative of the transport company. Only goods that are damaged, unopened and unused, can be returned within 5 days from the date the order was delivered.
Possibly defective units (for example, a pump that will not depress) must be mailed by you (after receiving authorization) to CANDORVISION to be analyzed. If a defect is confirmed, a replacement item will be shipped at no charge.

Reasons that may not be considered for refund or replacement include, but are not limited to, the following:

Patient does not like the product: If a patient purchases a CANDORVISION product and later on does not like it, CANDORVISION unfortunately cannot accept responsibility. Samples provided for demonstration and testing in the exam / consultation rooms enable health professionals to obtain patient feedback prior to purchase.
Patient intolerance to the product: As indicated in the product leaflet, sensitivities to the products are possible in rare single cases and CANDORVISION does not refund or replace items for this reason. Samples provided for demonstration and testing in the exam / consultation rooms enable health professionals to obtain patient feedback prior to purchase.
Accusation of under-filled units: The manufacturing process includes strict controls, with full documentation, that ensure accurate filling of all products. Claims for under-filling can usually not be confirmed and therefore will usually not be accepted.
Expired or short-dated products will not be replaced or refunded. CANDORVISION provides adequate dating for all shipped items to be retailed within the labeled expiration dates. Customers can contact CANDORVISION prior to ordering and enquire about the shelf-life of current batches shipped.
Products damaged by fire, smoke, heat, water, negligence or improper storage will not be refunded or replaced.

Product Shipped in Error: For products shipped in error by CANDORVISION please contact us immediately, or at most within 5 days from the date the order was delivered. Products can be returned collect via CANDORVISION’s carrier of choice, or an additional invoice can be created if the customer wants to keep the excess product. Overshipments discovered at a later date may be invoiced to customers by CANDORVISION.

Cancellation Policy: Orders can be cancelled only if the goods have not been shipped from the warehouse. A cancellation fee of $50 will apply.

Liability: CANDORVISION cannot be held liable for any failure to fulfill any contract or supply due to labour disputes, fires, explosions, floods, riots, lock-outs, injunctions, interruptions of transportation, unavoidable accidents, inabilities to obtain supplies at reasonable prices, inability to supply, or other causes beyond its control. Candorvision’s liability is limited to the repair or replacement, at Candorvision’s option, of Products that do not conform with the product specifications of the particular product. CANDORVISION MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE PRODUCTS AND DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, QUALITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE EXTENT PERMITTED BY APPLICABLE LAW.

CANDORVISION shall not be liable for any injury or damage suffered by a patient as a result of prescription, recommendation, selection and use of any CANDORVISION product by the health professional. The health professional shall exercise sole judgment and bear sole responsibility for prescribing, recommending the use of a CANDORVISION product for any particular patient or patient’s condition.

Other: No license or ownership of any intellectual property or other proprietary right is granted or implied hereunder. Unless specifically accepted in writing and signed by the President of Candorvision, any terms proposed or submitted by a customer at any time (including, but not limited to, terms or provisions in the customer’s purchase order, instructions or other document) which differ from these Terms and Conditions of Sale are rejected and shall be of no force or effect. Furthermore, special terms or conditions of prior orders, including special pricing, will not automatically apply to subsequent orders. Each order accepted by Candorvision will be treated as a separate contract between Candorvision and the customer. These Terms and Conditions of Sale may be updated or changed from time to time and the date of such change will be indicated at the top of this document (e.g. Updated: July 26, 2017). If you proceed with the Order, you are deemed to accept the changes.

Severability

If any term or provision of the Terms of Use and the above Terms and Conditions of Sale or the application thereof shall be invalid or unenforceable, such term or provision shall be severed from the Terms of Use and the above Terms of Trade and the remainder of the Terms of Use and the above Terms of Trade shall be unaffected thereby and each remaining term or provision of the Terms of Use and the above Terms of Trade shall be valid and be enforced to the extent permitted by law.

Entire Agreement

CANDORVISION’s Terms of Use and the above Terms of Trade constitute our entire agreement and supersede any and all other agreements between you and CANDORVISION. Any alteration to these Terms will be effective only if in writing and signed by an authorized agent of CANDORVISION. CANDORVISION reserves the right to change any part of this agreement at any time without notice.
